6. Uso aceptable
No está permitido usar la plataforma para:
- contenido ilegal, que infrinja derechos de terceros, de odio, acoso o de carácter sexual explícito;
- enviar spam o comunicaciones sin el consentimiento necesario;
- intentar acceder a datos de otros negocios, saltarse límites técnicos o atacar el servicio;
- tratarlos solo para prestarte el servicio y siguiendo tus instrucciones;
- exigir confidencialidad a quien acceda a ellos y aplicar medidas de seguridad adecuadas;
- usar solo los subencargados indicados en la política de privacidad, avisándote de los cambios;
- ayudarte a atender los derechos de las personas y a notificar brechas de seguridad;

Terms and conditions
These terms govern the use of the platform modoventa.com, owned by Expert Business Solutions LLC, a company organized in Wyoming (USA), with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801, USA, EIN 41-3377306 and corporate website expertbusinesssolutions.io. By creating an account or using the platform you accept them. Contact: hola@expertbusinesssolutions.io.
1. What we offer
Software for creating and managing communities, courses, challenges, events, webinars, websites, forms, contacts and payments. There are two types of users: businesses (trainers or companies that create communities and sell) and members (the people who join them).
2. Accounts
- You must be at least 16 years old and provide truthful information.
- You are responsible for keeping your password safe and for everything done with your account.
- We may suspend accounts that breach these terms or the law.
3. For businesses
- Your content is yours. You only grant us the permission needed to host it and show it to whoever you decide.
- You are the controller of your members' and contacts' data and are responsible for complying with the laws that apply to you (data protection, consumer protection, invoicing and taxes, advertising). We act as processor as described in section 10.
- Your sales are yours. When you charge with your own connected Stripe account, the purchase contract is between you and your customer: you set prices, conditions and refunds and issue the corresponding invoices. The platform may charge a commission per sale, which you will see before activating it.
- If you use features such as the simulated viewer counter or scheduled comments in webinars, you are responsible for using them in a way that does not mislead consumers under the law of your country.
- You are responsible for the taxes on your sales (for example, VAT on digital services sold to EU consumers) and for correctly labeling the type of each product: only pre-recorded digital content allows the buyer to waive the right of withdrawal; memberships, communities, mentoring programs and services keep the 14-day withdrawal right with a proportional refund.
- Email marketing and automations: you may only send commercial communications to people who have given their consent or where the law allows it. The platform adds an unsubscribe link and the sender's address to every email and does not send to anyone who has unsubscribed. You may not import purchased lists or lists of people who did not authorize you.
- Affiliate program: the agreement with your affiliates is yours. You set the commissions and conditions, decide when they are approved and pay them directly; the platform only calculates and records the commissions.
- Paid plans renew automatically until you cancel them; cancellation takes effect at the end of the paid period.
4. For members
- Each community is managed by an independent business, which decides its content, price and rules and may ask you to accept its own access agreement.
- Purchases of access to communities or courses are made from the business that sells them; questions about payments or refunds should be addressed to that business first.
- You may not share your access or copy or redistribute the content without its author's permission.
- Your withdrawal and refund rights are explained in Withdrawal and refunds.
5. For affiliates
- If a business registers you as an affiliate, your relationship is with that business, which sets your commission and pays it to you.
- When you share it, you must clearly state that it is an affiliate link or a paid recommendation (for example, "affiliate link" or "#ad"), and you may not spam, make false promises about the product or buy the product yourself through your own link.
- You are responsible for declaring your commissions for tax purposes.
6. Acceptable use
The platform may not be used for:
- illegal content, content that infringes third-party rights, or hateful, harassing or sexually explicit content;
- sending spam or communications without the necessary consent;
- attempting to access other businesses' data, circumvent technical limits or attack the service;
- selling products or services prohibited by Stripe or by law.
7. Availability
We work to keep the platform always available, but there may be interruptions due to maintenance or causes beyond our control. Some features depend on third-party services (Stripe, Zoom, WhatsApp, email providers) and on the business connecting them.
8. Liability
The platform is provided "as is". To the extent permitted by law, we are not liable for indirect damages or loss of profits, and our total liability to a business is limited to what it has paid us in the previous 12 months. Nothing in these terms limits the rights that the law of your country grants to consumers and that cannot be excluded.
9. Closing your account
You may delete your account at any time. A business may export its contacts before leaving. After you leave, we will delete the data in accordance with the privacy policy.
10. Data processing (businesses)
For the data of your members and contacts, we undertake to:
- process it only to provide you with the service and following your instructions;
- require confidentiality from anyone who accesses it and apply appropriate security measures;
- use only the sub-processors listed in the privacy policy, notifying you of any changes;
- help you respond to individuals' rights requests and notify security breaches;
- delete or return it to you when the service ends, unless we are legally required to keep it.
11. Governing law
These terms are governed by the laws of the state of Wyoming (USA). If you are a consumer residing in the European Union, you keep the protection of the mandatory rules of your country and may bring proceedings before its courts.
12. Changes
We may update these terms. If the change is significant, we will notify you in advance on the platform or by email.
